# 14 States Join Mifepristone Petition to FDA

Officials in 14 states (13 attorneys general and one governor) say they are joining four other states in their petition to FDA, asking the agency to eliminate the mifepristone REMS program that controls access to the drug that is the most common means of abortion in the U.S. In their 8/14 [petition](https://agportal-s3bucket.s3.us-west-2.amazonaws.com/CitizenPetition%5F20250820.pdf?VersionId=ykGGuu3F3QVYDYWMEVPCI8hMtKtG7XSx&ref=fdaweb.com), the states say that if the agency chooses not to eliminate the REMS program, it should use its enforcement discretion not to enforce its requirements in the 18 named states. “This requested action will minimize unnecessary and burdensome requirements and maximize access to this critical medication,” the petition says.

The states make these points:

- medication abortion is the primary means by which patients access abortion in petitioner states;
- medication abortion is safe in petitioner states;
- the mifepristone REMS program unduly burdens patient access without improving patient safety in petitioner states; and
- the petitioner states have enacted laws and regulations to ensure the safety of medication abortion in their states.

“In sum,” the petition concludes, “given mifepristone’s well-established safety record in the United States over the last 25 years, its critical importance for abortion care and miscarriage management in petitioner states, and the undue burdens the mifepristone REMS program places on patient access and the healthcare delivery system, the mifepristone REMS program should be removed in its entirety or, alternatively, FDA should exercise its discretion not to enforce the mifepristone REMS program (or elements thereof) in petitioner states.”
