# $150 Million AndroGel Verdict Overturned

An Illinois federal judge has overturned a $150 million verdict against AbbVie in a case that alleged the company fraudulently misrepresented the risks of its AndroGel testosterone replacement drug. According to Reuters, the judge [found](https://www.reuters.com/article/us-abbvie-androgel/u-s-judge-tosses-verdict-against-abbvie-in-androgel-case-idUSKBN1EG28U?ref=fdaweb.com) that the findings by a jury that rendered its verdict 7/2017 were “logically incompatible.”

The jury awarded an Oregon resident $150 million in punitive damages, but did not award any compensatory damages. AbbVie says it is facing about 4,500 cases over injuries blamed on AndroGel.

The jury concluded that AbbVie was not negligent or strictly liable for a heart attack that the plaintiff said he suffered after using the product, Reuters says, and concluded that the company falsely marketed the drug.

The judge held that the “irreconcilable conflict between the jury’s finding of liability on the fraudulent misrepresentation claim and award of zero compensatory damages requires a new trial on this claim.” The judge also vacated the punitive damages award and scheduled a new trial for March.
