# Appeals Court Upholds Norwich ANDA Delay

The Court of Appeals for the Federal Circuit has affirmed the 5/17/2023 decision of the Delaware federal court to deny Norwich Pharmaceutical’s petition to modify the court’s final order preventing FDA from approving Norwich’s ANDA for a generic form of Salix’ Xifaxan (rifaximin) 550 mg before 10/2/2029\. Salix [reports](https://finance.yahoo.com/news/court-appeals-federal-circuit-issues-170300088.html?ref=fdaweb.com) the appeals court also maintained the lower court’s decision that invalidated certain Xifaxan patents.

Xifaxan is indicated to reduce the risk of overt hepatic encephalopathy recurrence in adults and to treat irritable bowel syndrome with diarrhea in adults.
