# Biden Retreats From Woodcock Commissioner Nomination

The Biden Administration reportedly has ruled out nominating FDA acting commissioner **Janet Woodcock** for the agency’s top post due to lawmakers’ objections. Based on government regulations, she can remain in her current acting role until mid-November. However, if a different nominee is named, then she can remain in her temporary post until the confirmation process is completed, according to a [Bloomberg news report](https://www.bloomberg.com/news/articles/2021-08-19/janet-woodcock-ruled-out-for-permanent-fda-commissioner-post?ref=fdaweb.com).  

Senator **Joe Manchin** (D-WV), who is a needed vote for Senate confirmation, has been on record opposing Woodcock due to concerns about how liberally FDA approved opioids when Woodcock was CDER director. There is also push back from lawmakers concerned about maintaining the status quo following the recent controversial accelerated approval of Biogen’s Alzheimer’s drug.
