# Biogen Pays $22 Million on Anti-Kickback Charges

Biogen has agreed to pay $22 million to resolve allegations that it violated the False Claims Act by illegally using two foundations, Chronic Disease Fund (CDF) and The Assistance Fund (TAF), as conduits to pay Medicare co-pays for patients taking the company’s multiple sclerosis drugs, Avonex and Tysabri. According to a Justice Department [release](https://click.connect.hhs.gov/?qs=cce62f7a0ef4f131b8622806de89fab2033f86f347dd302f9a78251d6a82fabd82815a6e818badb0766ff231f92c16845e7174bae3d17f5f&ref=fdaweb.com), Biogen used CDF and TAF, each of which claimed status as a nonprofit organization for tax purposes, to help pay co-pay obligations of thousands of Medicare patients. According to the government, Biogen violated the anti-kickback statute and “undermined Medicare’s co-pay structure, which Congress designed to safeguard against inflated drug prices.”
