Bioventus Paying $3.6 Million for False Claims Violations

The Department of Justice says global medical technology company Bioventus is paying over $3.6 million to resolve allegations that it violated the False Claims Act by submitting improperly completed certificates of medical necessity for medically unnecessary devices from 10/1/12 through 12/31/18. A department statement says Bioventus made a written self-disclosure on 11/30/18 relating to its Exogen device, an ultrasonic bone growth stimulator. The company reported it had discovered that its sales representatives were sometimes completing a section of the medical necessity certificate that is to be completed by treating doctors.

The department says the company fully cooperated with the government’s investigation into the self-disclosure.
