# Boston Scientific Paying $189 Million to Settle State Mesh Cases

A multi-state settlement with Boston Scientific Corp. will require it to pay $188.6 million to 47 states and the District of Columbia to settle allegations that it deceptively marketed its transvaginal surgical mesh devices to patients. A [statement](https://oag.ca.gov/news/press-releases/california-department-justice-announces-1886-million-multistate-settlement?ref=fdaweb.com) issued by the California Department of Justice says the state will receive $19.3 million from the settlement. The suit alleged that Boston Scientific misrepresented the safety of the products by failing to disclose the full range of potentially serious and irreversible complications caused by mesh including chronic pain, voiding dysfunction, and new onset of incontinence.

The statement says the company has agreed to these marketing, training, and clinical trial reforms: 

- disseminate marketing materials for consumers describing complications in understandable terms;
- disclose significant complications in certain marketing materials, including the inherent risks of mesh;
- inform healthcare providers of significant complications during Boston training on procedures for insertion and implantation; and
- maintain policies about independent contractors, agents, employees who sell, market, or promote mesh to be adequately trained to report patient complaints and adverse events to the company;
- disclose the company’s role as a sponsor and any author’s potential conflict of interest when submitting a clinical study or clinical data on mesh for publication; and
- register all Boston Scientific-sponsored clinical studies about mesh at clinicaltrials.gov.
