CBD Product Bill Introduced

Sens. Ron Wyden (D-OR), Rand Paul (R-KY), and Jeff Merkley (D-OR) have introduced legislation to ensure hemp-derived CBD (cannabidiol) products are regulated by FDA like other legal products used in dietary supplements, foods, and beverages. A joint statement (contains links to the bill text and bill summary) says the Federal Food, Drugs, and Cosmetics Act (FFDCA) prohibits any new dietary ingredient, food, or beverage from entering the market if it has been studied or approved as a drug.

FDA has the authority to exempt items from this prohibition, the senators say, but has not done so for CBD, despite congressional action to legalize the products’ production and sale.

Wyden, Paul, and Merkley’s bill, The Hemp Access and Consumer Safety Act, would exempt hemp-derived CBD from the prohibition, allowing FDA to regulate such products like all other new dietary ingredients, foods, and beverages.

The senators say their bill:

allows hemp-derived CBD products to lawfully be used in dietary supplements, foods, and beverages under the FFDCA;
prioritizes consumer safety, requiring manufacturers to comply with all existing federal regulations for the products that contain CBD; and
ensures that these products are properly labeled.
