# CBD Qualifies as ‘Old Dietary Ingredient’: Petition

A Natural Products Association petition to FDA asks the agency to stop excluding hemp-derived cannabidiol (CBD) from the definition of a dietary supplement. A *Nutritional Outlook* online [post](https://www.nutritionaloutlook.com/view/citizen-s-petition-from-npa-requests-that-fda-recognize-cbd-as-dietary-ingredient-or-review-premarket-notification-of-cbd-on-case-by-case-basis?ref=fdaweb.com) (includes a link to the petition) says the trade group specifically asks that FDA: 

- determine CBD is not excluded from the legal definition of a dietary supplement; or
- determine that the FDA commissioner has the ability to exercise enforcement discretion in a specific and selective manner consistent with the premarket safety review of a new dietary ingredient notification; or
- recommend and support the HHS secretary issuing a regulation after notice and comment establishing that CBD would be lawful under the Federal Food, Drug, and Cosmetic Act.

The petition says that CBD qualifies as an “old dietary ingredient” that was marketed as a dietary supplement before the passage of the Dietary Supplement Health and Education Act.
