Court OKs FDA Ozempic Drug Shortage Action

A Texas federal judge has upheld FDA’s action in removing Novo Nordisk’s Ozempic and Wegovy (both semaglutide) from its drug shortage list. CNBC reports the decision is a blow to compounding pharmacies that had been allowed to produce hundreds of thousands of doses of copies of the obesity drugs while FDA said there was a shortage of them.

The Outsourcing Facilities Association brought suit against FDA in hopes of being able to continue to produce the drugs. The association had alleged that the agency acted recklessly in removing semaglutide from the shortage list while there was evidence that the drugs were still in short supply.

The judge had denied the compounding pharmacies’ request for an injunction in April, blocking them from making drug copies while the litigation was pending.
