CRN Praises Court Decision in Fish Oil Case

The Council for Responsible Nutrition (CRN), which represents dietary supplement and functional food manufacturers, says it applauds a Supreme Court decision not to hear an Amrin Pharma appeal of a lower court ruling in a fish oil case. In a statement, CRN says the decision “maintains FDA’s proper jurisdiction to interpret and enforce the provisions of the Federal Food, Drug, and Cosmetic Act (FFDCA), including the complex question of whether or not a substance is a dietary supplement.”

The issue first came up in 2017, CRN says, when Amrin asked the International Trade Commission to declare concentrated EPA fish oil to be a drug and to prohibit its importation for use in supplements.

CRN says it has been fighting the case since the beginning to maintain FDA’s exclusive jurisdiction over the FFDCA, protect legitimate manufacturers selling fish oil supplements, and ensure that consumers have access to concentrated omega-3 fish oil supplements without a prescription.
