DeSantis Introduces Reciprocity Bill

Rep. Ron DeSantis (R-FL) has introduced the Reciprocity Ensures Streamlined Use of Lifesaving Treatments (RESULT) Act of 2016 (H.R. 6241), to provide for reciprocal marketing approval of certain drugs, biological products, and medical devices that are authorized to be lawfully marketed abroad but not in the U.S. The legislation would authorize the HHS secretary to grant reciprocal marketing ability if certain specified conditions are met dealing with lawful marketing authorization in specific foreign countries.

HHS would be required to report to Congress monthly on reciprocal marketing requests that have been declined. The secretary’s decision could be overturned by a joint resolution of disapproval from the House and Senate.
