Device ‘Least Burdensome’ Concept/Principles Guide

FDA has published a final guidance entitled The Least Burdensome Provision: Concept and Principles, to describe the guiding principles and recommended approach for FDA staff and industry to facilitate consistent application of least burdensome principles, as required by Congress in the FDA Modernization Act of 1997 for medical device premarket evaluation. The document retains an earlier “least burdensome” definition as “the minimum amount of information necessary to adequately address a regulatory question or issue through the most efficient manner at the right time.” Topics covered in the guidance are Introduction, Background, Scope, Guiding Principles, Application of Least Burdensome Principles, Compliance Policies that Support the Goals of the Least Burdensome Concept, and Conclusion.
