# DoJ Collects $2.2 Billion in 2022 False Claims Actions

The U.S. Department of Justice (DoJ) says over $2.2 billion was collected in settlements and judgments against health care defendants under the False Claims Act during fiscal year 2022\. “The government and whistleblowers were party to 351 settlements and judgments, the second-highest number of settlements and judgments in a single year,” it says. The number of settlements and judgments last year shows how important a tool the False Claims Act has become for DoJ.

The [government says](https://www.justice.gov/opa/pr/false-claims-act-settlements-and-judgments-exceed-2-billion-fiscal-year-2022?ref=fdaweb.com) that over $1.7 billion of the $2.2 billion in settlements/judgments related to cases involving drug and medical device manufacturers, durable medical equipment, hospitals, pharmacies, physicians, and others.

The largest settlement last year involved Mallinckrodt ([see earlier story](https://www.fdaweb.com/mallinckrodt-pays-260-million-on-false-claims-violations/)) and its agreement to pay $260 million to resolve allegations that it violated the False Claims Act by knowingly underpaying Medicaid rebates due for its drug H.P. Acthar Gel, and using a foundation as a conduit to pay illegal co-pay subsidies for the product in violation of the Anti-Kickback Statute. As part of the settlement, Mallinckrodt also entered a five-year corporate integrity agreement that “contains unique drug price transparency provisions and monitoring provisions focused on Medicaid rebate and patient assistance program activities,” according to DoJ.
