Edwards, Boston Settle all Patent Disputes for $180 Million

As part of an agreement to resolve all long-standing patent disputes between the two companies, Edwards Lifesciences is making a one-time payment of $180 million to Boston Scientific. The two firms have been involved for several years in litigation over heart valve replacement systems, including transcatheter aortic valves, in the U.S. and Europe.

“All pending cases or appeals in courts and patent offices between the two companies will be dismissed,” Edwards says in a statement, “and the parties will not litigate patent disputes related to current portfolios of transcatheter aortic valves, certain mitral valve replacement devices, and left atrial appendage closure devices. Any injunctions currently in place will be lifted.”

Edwards says no further royalties will be owed by either company and additional terms of the settlement remain confidential.

Financial analysts told Reuters the settlement was a “win-win” and could be positive for the industry as a whole.
