Endo Hit with $2 Billion Fine Over Opioid Sales

Endo Health Solutions has agreed to plead guilty in federal court and pay over $2 billion in penalties to resolve criminal and civil investigations related to the company’s sales and marketing of the opioid drug Opana ER with INTAC, according to a Justice Department release.

“The criminal resolution includes the second-largest set of criminal financial penalties ever levied against a pharmaceutical company, including a criminal fine of $1.086 billion and an additional $450 million in criminal forfeiture,” the government says. Endo also has agreed to a civil settlement of $475.6 million to resolve civil liability claims under the False Claims Act that are intended to address alleged losses to federal healthcare programs that paid for Opana ER. “The proposed resolution includes a corporate criminal release regarding conduct relating to the sale, marketing, and distribution of Opana ER, but does not release any individual criminal liability,” it adds.

“Combating the opioid epidemic remains a top public health priority for the (FDA),” CDER director Patrizia Cavazzoni is quoted in the release as saying. “This case demonstrates FDA and the Justice Department’s commitment to work collaboratively to hold drug manufacturers accountable if they fail to share accurate information with health care professionals about the risks and benefits of opioids.”

Additionally, the government notes that Endo filed for bankruptcy protection in 2022 and these monetary penalties settle criminal and civil claims under the bankruptcy case. Under the bankruptcy agreement, the government will be paid up to an additional $464.9 million over 10 years.
