# Ex-Sales Rep Debarment Withdrawn

*Federal Register* notice: The FDA is issuing an order to withdraw its 1/25 debarment of former Aegerion Pharmaceuticals sales representative **Mark Moffett** because the U.S. Court of Appeals for the First Circuit vacated his convictions and sentence. The government alleged that Moffett played a role in persuading physicians to prescribe Juxtapid for statin-intolerant patients who had not been diagnosed with homozygous familial hypercholesterolemia (HoFH), which is the drug’s approved indication. They contended that he schemed to increase his bonus pay for obtaining and retaining Juxtapid prescriptions by falsely representing the patients had HoFH, and causing the false completion of risk evaluation and mitigation strategy forms, statements of medical necessity, and insurance forms that were submitted for coverage, according to an earlier [FDA notice](https://www.govinfo.gov/content/pkg/FR-2023-01-25/pdf/2023-01426.pdf?ref=fdaweb.com). Last year, a jury convicted Moffett on nine counts of wire fraud and five counts of aggravated identify theft. He was sentenced to 54 months in prison, $1,500 restitution payment, and upon his release from prison, a 36-month supervised release.
