# FDA Continues to Act on CBD Health Claims: Attorneys

Two Troutman Pepper attorneys cite four FDA March Warning Letters to companies selling CBD products as evidence that the agency is taking a strong stance on product labeling and marketing efforts involving health claims about CBD. Their online [post](https://www.jdsupra.com/legalnews/fda-remains-vigilant-against-cbd-9775258/?ref=fdaweb.com) also says that two of the four letters cited companies for making Covid-19-related claims.

“Manufacturers and retailers should be careful not to market their products as providing any health benefits,” the attorneys write.

They also caution that FDA maintains that it is illegal to market in interstate commerce any food to which a substance that is an active ingredient in an approved drug product has been added. This is relevant to CBD companies, they say, because CBD is an active ingredient in one approved drug product.

An important takeaway from the March letters, according to the attorneys, is that one of the letters was directed at products that combined CBD with other claimed homeopathic remedies such as magnesium and silver. “The presence of more than one ingredient touted to have health benefits will surely raise a red flag at FDA,” they say.

Finally, two of the letters were based on agency facility inspections, while the other two appear to have been based solely on a review of the companies’ Web sites and social media marketing presences.
