# FDA Denies Vaccine EUA Revocation Petition

FDA has denied a 9/27 citizen petition submitted by the Informed Consent Action Network asking it to revoke the emergency use authorizations (EUAs) granted to the Moderna and Johnson & Johnson Covid-19 vaccines. FDA [says](https://downloads.regulations.gov/FDA-2021-P-1045-0004/attachment%5F1.pdf?ref=fdaweb.com) the petition argued the EUAs should be revoked because Pfizer/BioNTech’s Comirnaty is an “adequate, approved, and available alternative” and thus the Moderna and J&J vaccines are not needed.

The letter says the network has a flawed understanding of the regulatory framework for EUAs and says there is no basis for the petition’s assertion that FDA must revoke the EUAs for Moderna and J&J vaccines since there is no legal requirement that the EUAs be revoked with the approval of Comirnaty.

The letter says the network ignores the discretion Congress gave the agency in the law. It says it also failed to provide any data or information supporting its view that the approval of Comirnaty means there is an adequate and available supply of a Covid vaccine such that the other vaccines are no longer needed.

“There is still need and demand for Covid-19 vaccines and having sufficient supply is crucial for ensuring that vaccines are available to protect individuals against Covid-19,” FDA says.
