FDA Extends Comment Period in Intended Use Rule

Federal Register notice: FDA has extended until 7/18 the comment period on a final rule that clarifies for drug and device manufacturers the agency’s interpretation and application of its existing definitions of “intended use” (see earlier story). The comment extension is related to a citizen petition from medical product groups (see story) that sought an indefinite stay of the rule. The petition said that agency staff should be directed to promulgate final definitions of intended use that are consistent with the proposed definitions set out in a 9/25/15 notice of proposed rulemaking. FDA has already announced delayed implementation of the 1/9 rule to give the Trump administration time to consider what it wants to do with it. To view the notice, click here.
