FDA Says Valentus Marketing Several Unapproved New Drugs

FDA says its review of the Web site maintained by Valentus, Inc., Sioux Falls, SD, determined that the company takes orders for several products that the Federal Food, Drug, and Cosmetic Act considers to be unapproved new drugs because they are intended for use in the cure, mitigation, treatment, or prevention of disease. An 11/30 Warning Letter gives examples of the Web site statements that establish that the products are legally considered to be drugs. The letter also says the products are misbranded.

Valentus was told to take prompt action to correct the violations and prevent their recurrence and to respond with a list of specific steps taken, documentation for each step, and a timetable for completing the corrections.
