# FDA Spending Bill Will See Veto: White House

The Biden Administration says that if HR 4368, which includes FDA’s FY 2024 spending measure, were presented to the president for signing, he would veto it. In a [statement](https://www.whitehouse.gov/wp-content/uploads/2023/07/SAP-H.R.-4368.pdf?ref=fdaweb.com) articulating the Administration’s objection to the bill, the White House says it is concerned that the cuts to FDA’s budget would “leave the FDA underprepared to address ongoing and urgent public health challenges in FY 2024… The Administration stands ready to engage with both chambers of the Congress in a bipartisan appropriations process to enact responsible spending bills that fully fund federal agencies in a timely manner.”

The House spending bill provides $3.5 billion in direct budget authority, and $3.1 billion in authorized user fees— for a total budget of $6.6 billion. Under the budget proposed in March ([see earlier story](https://www.fdaweb.com/fda-seeks-372-million-10-budget-boost-for-fy-2024/)), the agency was seeking a $372 million (10%) boost and a $150 million increase in user fees. The total FDA funding being proposed was $7.2 billion.

According to House appropriators’ figures, $400 million is being shaved from FDA’s proposed user fee increases, and an additional $200 million is being cut from its direct budget authority. Compared to FDA’s FY 2023 approved budget, the FY 2024 budget authority being advanced is $100 million lower and user fees are staying flat.
