# FDA Wins Restraining Order Against Xephyr

The Eastern Oklahoma federal court has entered a temporary restraining order against Xephyr LLC, doing business as N-Ergetics, and three company officials that requires them to immediately stop distributing colloidal silver products. The company offered the products for sale to treat coronavirus and other diseases. In granting the order, the court found that the firm is violating the federal Food, Drug, and Cosmetic Act (FD&C) by unlawfully distributing unapproved new drugs and misbranded drugs. “The court also found that there is a danger that the defendants will continue violating the law without the temporary restraining order,” an [FDA release](https://www.fda.gov/news-events/press-announcements/coronavirus-covid-19-update-federal-judge-enters-temporary-injunction-against-xephyr-llc-doing?utm%5Fcampaign=Federal%20judge%20enters%20temporary%20injunction%20against%20Xephyr%20LLC%20doing%20business%20as%20N-Ergetics&utm%5Fmedium=email&utm%5Fsource=Eloqua) says.  

Xephyr has made claims that the products can cure, mitigate, prevent or treat Covid-19, or other diseases like cholera, diabetes, cancer and AIDS. FDA and the FTC previously issued a [Warning Letter](https://www.fda.gov/inspections-compliance-enforcement-and-criminal-investigations/warning-letters/xephyr-llc-dba-n-ergetics-604588-03062020?ref=fdaweb.com) to Xephyr about its colloidal silver products. FDA says the company removed its Covid-19-related Web pages for a time, but by the end of April it had resumed marketing the products again.
