A federal judge 4/7 declined to immediately restrict access to the abortion pill mifepristone, instead pausing a high-profile lawsuit brought by Louisiana and allowing current nationwide access — including distribution by mail — to continue for now.

In a ruling that temporarily favors the status quo, U.S. district judge **David Joseph** denied Louisiana’s request to block a 2023 FDA rule permitting the drug to be prescribed via telehealth and dispensed through the mail. The judge also agreed to put the broader case on hold while the agency completes an ongoing safety review of the medication.

Joseph wrote that allowing the FDA’s “evidence-based” review to proceed was in the public interest, signaling reluctance to intervene before the agency reaches a scientific determination.

The case is one of several ongoing challenges targeting FDA’s authority over drug regulation and the expanding use of telehealth to provide abortion services, particularly in states where the procedure is restricted or banned.

Drug manufacturers and abortion rights advocates welcomed the ruling as preserving access in the near term, while state officials signaled plans to continue legal challenges, setting the stage for further litigation over one of the most contested drugs in the U.S. healthcare system.
