# Feds Looking at Medical Record AI: Bloomberg

The Department of Justice (DoJ) is looking at the use of artificial intelligence (AI) embedded in patient records that prompts doctors to recommend specific treatments. *Bloomberg Law* [reports](https://news.bloomberglaw.com/us-law-week/dojs-healthcare-probes-of-ai-tools-rooted-in-purdue-pharma-case?ref=fdaweb.com) that department investigators want to learn more about generative technology’s role in facilitating anti-kickback and false claims violations. The newsletter says the probe comes as electronic health record vendors are integrating more sophisticated AI tools to match patients with particular drugs and medical devices.

Bloomberg says it’s not clear how advanced the investigation is, with two sources saying that DoJ attorneys are asking general questions, possibly indicating a strategy is still being formulated. The department declined to comment to *Bloomberg Law*.

“The technology relies on algorithms that mine health data, spot trends, and identify patients who may have certain conditions and be eligible for remedies that physicians might not otherwise consider,” the report says. “That can eventually help save lives and make healthcare delivery more efficient, while also easing AI abuse by profit-seekers peddling their products to doctors.”

*Bloomberg* says the probes bring fresh relevance to two 2020 criminal settlements with Purdue Pharma and its digital records contractor Practice Fusion over their collusion to design automated pop-up alerts pushing doctors to prescribe addictive painkillers. Practice Fusion paid a penalty of $145 million in that kickback scheme, the news service says.
