# Florida Gets $600K in Cochlear Implants Case

Florida has won a $600,000 payment to the state’s Medicaid program under a multistate action against cochlear implants maker Advanced Bionics. The state’s action grew out of a Department of Justice (DoJ) $12 million whistleblower settlement earlier this year ([see story](https://www.fdaweb.com/advanced-bionics-paying-12-million-over-false-claims/)) that resolved allegations that the firm misled federal healthcare programs about the radio-frequency (RF) emissions generated by some of its processors. A DoJ [statement](https://www.justice.gov/opa/pr/advanced-bionics-llc-pay-over-12-million-alleged-false-claims-cochlear-implant-processors?ref=fdaweb.com) said the settlement resolves allegations that the company, in submitting PMA applications to FDA for its Neptune and Naida processors, made false claims about the results of RF emissions tests. “Advanced Bionics allegedly represented that its processors satisfied an internationally recognized emissions standard when, in fact, Advanced Bionics did not comply with that standard,” it said.

In the Florida matter, attorney general **Ashley Moody** says the action resolves allegations that Advanced Bionics knowingly submitted, or caused to be submitted, false or fraudulent claims for reimbursement for cochlear device systems with Neptune and Naida sound processor components during a nine-year period. “Specifically, ABC allegedly misled the Food and Drug Administration to receive approval of the Neptune and Naida sound processors by lying about how items were tested,” Moody says in a [statement](http://www.myfloridalegal.com/newsrel.nsf/newsreleases/1B8D84B4B8456E13852589870057C01F?Open&&ref=fdaweb.com).
