Former Doctor, Sales Rep Guilty in Fraud Case

A federal jury has returned guilty verdicts against former Florida pain doctor Steven Chun and former Insys sales rep Daniel Tondre in a healthcare fraud kickback case, according to a Department of Justice statement. Both men were found guilty of conspiring to pay and receive kickbacks and bribes, in the form of speaker fees, in return for prescribing the fentanyl spray Subsys. They also were convicted on five separate counts of paying and receiving kickbacks on specific dates.

Tondre also was convicted of two counts of identification fraud in connection with the sham speaker events. Both men face a maximum penalty of five years in federal prison on the conspiracy count and up to 10 years in prison for each substantive kickback violation. And Tondre also faces up to five years in prison on each identification fraud count.

The statement says the government is seeking a money judgment in the amount of the proceeds of the kickbacks.
