# FTC Sues 2 Companies Over Joint Pain Products

The Federal Trade Commission sued two companies to stop them from falsely claiming that their pills are scientifically proven to alleviate joint pain by growing new bone and cartilage. The joint [complaint is against ZyCal Bioceuticals](https://www.ftc.gov/system/files/documents/cases/zycal%5Fcomplaint.pdf?ref=fdaweb.com), that has marketed a line of joint pain relief products under the brand name Ostinol, and against Excellent Marketing Results (EMR), which marketed a pill called StimTein through infomercials and online.

According to FTC, both products contain the same active ingredient, cyplexinol, and both companies claimed that they grow bone and cartilage, thereby providing relief from joint pain. The complaint contends that ZyCal supplied EMR with cyplexinol, and gave EMR product information, clinical studies, and other promotional material about its supposed health benefits. The agency also says that the claims made by both companies are false and not supported by scientific evidence, and that they both used deceptive testimonials to sell products.

EMR and its president, **Michael McGahee**, have agreed to settle the complaint for $3.6 million. Under a [proposed court order, they are prohibited from making health-related product claims](https://www.ftc.gov/system/files/documents/cases/zycal%5Fproposed%5Femr%5Fstipulated%5Forder.pdf?ref=fdaweb.com) unless such claims are supported by competent and reliable scientific evidence, FTC says. Additionally, the agency says it is proceeding with litigation against ZyCal Bioceuticals and its president **James Scaffidi**.
