Generic Symbicort Wins FDA Tentative Approval

FDA has granted Viatria and Kindeva Drug Delivery tentative approval for budesonide/formoterol fumarate dihydrate, the first generic version of AstraZeneca’s Symbicort, indicated for certain patients with asthma or chronic obstructive pulmonary disease. The tentative approval was issued due to ongoing patent litigation. On 3/2, the West Virginia Northern District federal court found AstraZeneca’s patent claims are not invalid for obviousness. Viatris and Kindeva say they disagree with the decision and intend to file an appeal. Symbicort had U.S. branded sales of $3.5 billion over the last year.
