# Gilead Sciences Settlement Helps 49 States

Pennsylvania attorney general **Dave Sunday** says his state is expected to receive $1.28 million as its share of a $202 million settlement that 49 attorneys general reached with Gilead Sciences for running an illegal kickback scheme to promote its HIV medication. In a [statement](https://www.attorneygeneral.gov/taking-action/ag-sunday-part-of-national-coalition-securing-200m-from-gilead-sciences-for-illegal-kickback-scheme-to-sell-hiv-drugs/?ref=fdaweb.com), Sunday says, “Gilead violated federal law by illegally providing incentives, including awards, meals, and travel expenses, to healthcare providers to prescribe Gilead’s medications, resulting in millions of dollars of false claims submitted to government healthcare programs.”

The settlement, which was approved by a New York federal court, provides $49 million for Medicaid programs nationwide ($642,189 for Pennsylvania), with the remainder going to Medicare, Tricare, and the AIDS Drug Assistance Program.

“Gilead used illegal kickbacks to corner the market on these lifesaving drugs needed by one million Americans living with HIV,” Sunday says. “We saw similar kickback schemes from drug manufacturers during the eruption of the opioid crisis. The money from the settlement will support people living with HIV and bolster prevention programs.”

Gilead’s internal compliance mechanisms failed to halt the violations, the statement says. The company maintained policies and procedures that failed to prevent its sales representatives from improperly offering incentives to induce prescriptions, it says.
