# HELP Republican Senators Urge FDA Mifepristone Action

Five Republican members of the Senate HELP Committee want FDA to take “immediate action to prevent misbranded and unapproved versions of the chemical abortion drugs mifepristone and misoprostol from being marketed in the U.S. by online retailers in violation of U.S. law.” In a [statement](https://www.help.senate.gov/rep/newsroom/press/chairman-cassidy-colleagues-launch-investigation-into-abortion-drug-manufacturers-urge-fda-to-crack-down-on-illegal-online-sellers?ref=fdaweb.com) (includes links to a 3/25 letter to FDA commissioner **Marty Makary** and to letters to three drug companies), the senators say they are also launching an investigation into the drug manufacturers’ compliance with FDA-mandated safeguards associated with marketing their drugs.

In the letter to Makary, the senators say the “illegal sale of these drugs harms women and undermines FDA’s core mission to protect American consumers through the regulation of medical products. The widespread online dispensing of chemical abortion drugs without medical supervision poses serious risks to women’s health and increases the risk of forced and coerced abortions.” The senators:

- urge FDA to issue additional Warning Letters to entities violating federal law by offering unapproved and misbranded chemical abortion drugs for sale to U.S. customers and to take further action against entities that refuse to take corrective action in response to Warning Letters;
- urge the agency to issue additional abuse complaints to Website registrars when Websites registered by their companies illegally offer misbranded and unapproved chemical abortion drugs for sale to U.S. consumers, and to use all available tools to take further enforcement action against registrars of Websites operating illegally to ensure they cease their illegal activities or are permanently shut down if they do not;
- prioritize working closely with Customs and Border Protection and the U.S. Postal Inspection Service to interdict shipments of unapproved and misbranded chemical abortion drugs both at the border and within the U.S., and to also work with the agencies and other partners to track where the illegal shipments are coming from and act against those using the U.S. mail system for illegal purposes; and
- prioritize working closely with the Justice Department to investigate and prosecute individuals and entities, including co-conspirators, who illegally sell unapproved and misbranded chemical abortion drugs to U.S. consumers and maximize the agency disbarment authorities against individuals who are convicted of felonies for illegally importing drugs into the U.S.

The senators also sent letters to Evita, Danco, and GenBioPro asking over 20 questions about their compliance with FDA regulations and the sourcing for their chemical abortion drug products.
