Illinois Jury Awards Man $3.2 Million in Androgel Suit

An Illinois federal jury 3/26 found AbbVie liable for injuries to an Oregon man allegedly caused by the company’s testosterone replacement therapy AndroGel. The jury ordered AbbVie to pay Jesse Mitchell $3.2 million in the fourth bellwether trial in federal multidistrict litigation (mdl) 2545 in the Northern District of Illinois.

During the trial, Mitchell’s attorneys blamed AbbVie for causing his heart attack by marketing AndroGel for “off-label” uses. They alleged that AbbVie knew that the product had not received approval to treat symptoms of testosterone deficiency caused by the natural aging process. The attorneys also alleged that the company failed to conduct a major clinical study on whether the drug increased cardiovascular risks until ordered to do so by FDA in 2015.
