# Inspector General EpiPen Records Sought

Sen. **Chuck Grassley** (R-IA) has asked the HHS inspector general to provide records on the 2009 identification of EpiPen’s misclassification that he says led to significant overcharging of taxpayers. Grassley also invited the inspector general to testify at an 11/30 Judiciary Committee hearing on the misclassification and a potential settlement with the Justice Department for the overcharges.

“The Office of Inspector General told Grassley staff that the office notified the Centers for Medicare and Medicaid Services (CMS) in 2009 that the EpiPen was misclassified under the Medicaid drug rebate program, meaning that taxpayers overpaid for the product,” a Grassley news [statement](http://www.grassley.senate.gov/news/news-releases/inspector-general-asked-provide-records-invited-testify-over-epipen?ref=fdaweb.com) says. “The taxpayers deserve answers on what happened between 2009 and now. It appears the EpiPen was misclassified for years, and CMS was notified of the problem. If no one did anything about the misclassification, why not? This could mean hundreds of millions of dollars in taxpayer over-payments occurred without justification.”
