# Janssen Sues to Block Counterfeit HIV Meds

Janssen has filed suit in New York federal court to stop several drug wholesalers and their executives/founders from distributing counterfeit forms of Janssen’s Symtuza (darunavir/cobicistat/emtricitabine/tenofovir alafenamide), a multi-drug HIV medication in one tablet. The Janssen [complaint](http://www.fdaweb.com/download.php?file=johnson%5F%26%5Fjohnson%5Flawsuit%5F4-2022.pdf) names Safe Chain Solutions, Propharma Distribution, Scripts Wholesale, **Steven Diamanstein**, **Levi Ellis**, **Charles Boyd**, **Patrick Boyd**, I Care Pharmacy 14 Inc., and **Edward Gendin**. It says the company received complaints from patients who found the wrong pills in bottles of Symtuza.

“Extensive investigation by Janssen confirmed that these bottles were counterfeits,” the suit says. “Defendants have distributed counterfeit Symtuza and other counterfeit Janssen HIV medications on a large scale.”

The company is asking for a permanent injunction to stop the defendants from selling any Janssen medication, whether genuine or counterfeit, and other actions it wants to be stopped. It also wants all infringing products to be turned over, seized, impounded, and/or destroyed, and it asks for punitive damages from each defendant of at least $25 million, plus other financial damages and recoveries.
