# Latest FDA Warning Letters

FDA has posted its latest batch of Warning Letters. They can be accessed by clicking on the link following each letter.

**ActiveHerb Technology**, San Diego, CA (5/15): FDA inspected the firm 9/2018 and determined that it was selling unapproved new drugs that were misbranded. FDA documented the firm’s marketing claims for the products that established that they met the definition of a drug under the Federal Food, Drug, and Cosmetic Act. It also listed drugs sold by the company that were intended to treat one or more diseases that are not amenable to self-diagnosis or treatment without the supervision of a licensed practitioner, making it impossible to write adequate directions for use to be followed by a layperson. And the letter listed significant label deviations for several of the products. **Kingston Pharma**, Massena, NY (5/14): FDA inspected the firm 11/2018 and cited significant GMP violations for finished pharmaceuticals and misbranding violations. For example, the company failed to establish adequate written responsibilities and procedures applicable to the quality control unit and to follow such procedures. It also failed to establish written procedures for production and process control designed to assure that the drug products the firm manufactures have the identity, strength, quality, and purity they purport or are represented to possess.
