# Mallinckrodt Paying $15 Million in False Claims Act Case

The Justice Department says Mallinckrodt has agreed to pay $15.4 million to resolve claims that when it was known as Questor it paid illegal kickbacks to doctors in the form of lavish dinners and entertainment to induce prescriptions for its H.P. Acthar Gel from 2009 through 2013\. The government [says](https://click.connect.hhs.gov/?qs=c5e421610ea1255ecb6755c129de261156574069f669cbf9afa790ca84f6f9886f65a73148f4791d504038cba84b9631e7646032be645be8&ref=fdaweb.com) that 12 Questor sales representatives marketing Acthar provided lavish meals and entertainment expenses to healthcare providers. The government says the remuneration to doctors was intended to induce Acthar Medicare referrals from them, resulting in a violation of the anti-kickback law and submission of false claims to Medicare.

The allegations originated in two whistleblower suits, the Justice Department says. The whistleblowers will receive about $2.929 million of the settlement.

The department says the government is continuing to pursue claims alleging that Mallinckrodt violated the False Claims Act by using a foundation as a conduit to pay illegal kickbacks in the form of Acthar copay subsidies. This settlement does not resolve those claims, it says.
