# McNeil Reaches Tylenol Settlement with 43 States

McNeil-PPC has reached a settlement with 43 state attorneys general to resolve allegations that the company distributed contaminated over-the-counter drugs and unlawfully promoted its products. Pennsylvania attorney general **Josh Shapiro** [announced](https://www.attorneygeneral.gov/Media%5Fand%5FResources/Press%5FReleases/Press%5FRelease/?pid=3400&ref=fdaweb.com) (includes link to settlement text) that the settlement would bring $1.4 million to his office to be used to fund future consumer protection efforts in the Commonwealth.

Shapiro says that McNeil operated a plant in Fort Washington, PA, and recalled hundreds of millions of packages of drugs manufactured between 2009 and 2011, including many for pediatric uses. The recalls followed reports of product oddities such as strange odors and particles found in liquid medicines that the company produced. A prior U.S. Justice Department investigation into the company’s quality control issues resulted in a misdemeanor guilty plea that included a criminal fine of $20 million and forfeiture of an additional $5 million, he says.

The states’ settlement resolves claims that McNeil unlawfully promoted its OTC drugs as compliant with federal good manufacturing practices. It restricts inappropriate advertising and adds investigative and reporting requirements that Shapiro says will create additional safeguards to protect consumers. In the event of a future recall, he says, the settlement requires the company to provide information to the attorneys general about the identity of wholesalers and warehouses where the OTC drugs subject to the recall were distributed.
