Notice of Eylea Biosimilar Patent Infringement Suit

Federal Register notice: FDA is providing notice that a patent infringement lawsuit has been filed against Amgen over its BLA submission for a biosimilar copy of Regeneron’s Eylea (aflibercept), indicated for treating wet age-related macular degeneration, diabetic macular edema, and diabetic retinopathy. The complaint is titled Regeneron Pharmaceuticals, Inc. v. Amgen Inc., 2:24–CV–00264 (CA Central District — filed 1/10). The agency notes that it has only a ministerial role that is limited to publishing notice of a complaint received under section 351(l)(6)(C) of the Public Health Service Act and does not perform a substantive review of the complaint.
