# Patient Groups Sue Over Drug Cost Rules

Three advocacy groups representing HIV, hepatitis, and diabetes patients are suing HHS and its Centers for Medicare and Medicaid Services over payment requirements under the 2010 Patient Protection and Affordable Care Act (Obamacare) that the groups say make it impossible for many people, even with insurance, to afford the drugs they need. The [suit](https://hivhep.org/wp-content/uploads/2022/08/CMS-Accumulator-Rule-HIV-%5F-Hep-Policy-Inst.-Complaint-8%5F25-clean.pdf?ref=fdaweb.com), filed in DC federal court, particularly targets copay accumulator adjustment programs under which insurers attempt to forbid patients from counting financial assistance provided by a drug manufacturer toward the patient’s co-pay obligation.

“Regrettably,” the suit says, “the federal agencies charged with implementing the Affordable Care Act have endorsed the efforts of large insurers and pharmacy benefit managers to impede access to innovative medicine by denying patients the benefits of contributions provided by drug manufacturers when calculating patient payment obligations.”
