# Philips $615 Million Settlement Over Faulty Devices

Royal Philips and its U.S. subsidiaries, including Philips Respironics, have allocated $615 million under an agreement to resolve all “economic loss claims” in the U.S. Multidistrict Litigation (MDL) related to Philips Respironics’ [voluntary recall](https://www.usa.philips.com/healthcare/e/sleep/communications/src-update?ref=fdaweb.com) of certain sleep and respiratory care devices. This settlement, which is being filed in Western Pennsylvania federal court, “does not include or constitute any admission of liability, wrongdoing, or fault by any of the Philips parties,” the company says, adding that it also does not settle any personal injury or medical monitoring claims in the MDL, which Philips has moved to dismiss.

Phillips has been under the microscope as it struggles to resolve issues surrounding its troubled ventilators, continuous positive airway pressure, and bilevel positive airway pressure machines. Last year, it said it was undergoing discussions ([see story](https://www.fdaweb.com/philips-discussing-consent-decree-over-respironics-recalls/)) with the Department of Justice (DoJ) on behalf of FDA about the proposed terms of a consent decree. The company also said it received a DoJ subpoena asking for information on the events that led to recent recalls of the devices ([see earlier story](https://www.fdaweb.com/justice-department-probe-on-philips-respironics-recall/)).

The settlement is subject to court approval and it would “provide predefined cash awards to all eligible participants in the U.S. depending on the type of device, extended warranties on all replacement devices, and an additional cash award if they return the recalled device to Philips Respironics,” the company says.
