# Resolve Off-label Communication Dispute: House Committee

Republican leaders of the House Energy and Commerce Committee say it’s time for FDA to stop delaying and “pursue thoughtful, Constitutionally-sound solutions that will provide certainty for the future” in terms of appropriate off-label communication. In an online blog [post](https://energycommerce.house.gov/news-center/blog-posts/administration-drags-feet-label-changes?ref=fdaweb.com), the leaders note that FDA announced in August a November hearing on off-label communications. “The agency’s willingness to publicly discuss these issues is a welcome yet long overdue development,” the post says, “and the recent string of FDA losses in the courts should expedite, not further delay, clarifying the rules of the road.”

The committee says it has led the calls for proposed statutory clarifications and has offered to work with FDA on a solution. The blog says that FDA responded to a May letter from the committee about its willingness to work with the agency with an answer three months later that said simply that it has been “engaging in a comprehensive review of its regulatory framework and working on draft guidance documents since at least 2014.”

The post cites a *National Law Review* suggestion that the FDA public hearing is a way to further delay moving forward and transfer the issue to the next administration.
