SEC Says Aveo Misled Tivozanib Investors
The Securities and Exchange Commission (SEC) has brought fraud charges against Aveo Pharmaceuticals and three of its former executives for misleading investors about company efforts to obtain FDA approval for its kidney cancer drug tivozanib. The SEC says the company hid the level of FDA concern about the drug in public statements to investors by omitting the critical fact that agency staff had recommended a second clinical trial to address concerns about patient death rates in the first clinical trial. Aveo never conducted the trial and the agency later refused to approve the drug.
Aveo agreed to pay $4 million to settle the charges without admitting or denying the allegations in the complaint filed in Boston federal court. The settlement is subject to court approval. The SEC says it is continuing its case against the three former executives.
