Senate Bill on FDA Seizing/Detroying Counterfeit Devices

U.S. senators Mike Enzi (R-WY) and Maggie Hassan (D-NH) have introduced legislation that would help protect patients from counterfeit medical products that could cause serious harm. Their Safeguarding Therapeutics Act would give FDA authority to seize and destroy counterfeit medical devices and products, including vaccines and combination products (e.g., EpiPens). The measure is the Senate companion to legislation introduced by U.S. representatives Brett Guthrie (R-KY) and Eliot Engel (D-NY), which is part of the latest coronavirus relief package passed by the House. The bill builds on the 2012 Food and Drug Administration Safety and Innovation Act, which gave the agency authority to seize and destroy counterfeit drugs, but not medical devices.
