Stay Sought in Vascepa 1st Amendment Case

Amarin says that it, FDA, and other parties have jointly requested a stay in court proceedings for the First Amendment litigation about commercial speech involving the company’s Vascepa. An 8/7/15 preliminary order confirmed the company’s right to engage in truthful and non-misleading speech promoting off-label uses of Vascepa. Following that order, the company says, the court was notified that the parties had spoken with each other and agreed to explore the possibility of a settlement. A stay is being requested until 3/18 because the settlement talks are continuing, Amarin says.
