# TX Man Gets 5 Years Over Unapproved Drugs

A New Braunfels, TX man, **Evan Asher Field**, was sentenced in federal court in San Antonio to five years in prison for selling unapproved drugs through the mail. According to a Justice Department [release](https://www.fda.gov/inspections-compliance-enforcement-and-criminal-investigations/press-releases/man-sentenced-five-years-prison-selling-misbranded-drugs?ref=fdaweb.com), Field and codefendant **Michael Dominic Diaz** purchased bulk quantities of various drugs, including synthetic opioids and benzodiazepines, and re-sold them through a Web site Field created in 2019\. “The drugs, most of which originated in China and were not regulated or approved for any use by the FDA, can potentially cause toxic and fatal overdoses if consumed by humans,” the release says.

Despite disclaimers on the Web site and product packaging stating “for research purposes only,” and “not for human consumption,” the defendants were aware that customers were consuming the drugs, the government contends. “Multiple consumers suffered overdoses, including some which were fatal,” it adds.

Field was also ordered to pay a $250,000 fine. Codefendant Diaz is scheduled to be sentenced on 11/21\. The case was investigated by FDA and the DEA.
