Using Real-World Evidence in Drug Advertising
Two Arnold & Porter attorneys say the issue of whether real-world evidence (RWE) will be accepted for use in drug advertising by regulators in FDA and around the world will depend on the quality and completeness of the data and the relevance of and purpose for which it will be used. In a paper (registration required), the attorneys describe the current landscape for using RWE in advertising medicinal products in the European Union and the U.S.
They identify these practical considerations when using RWE to support advertising claims:
- understanding why the RWE was collected;
- understanding how the RWE was collected; and
- describing other available data that might answer the question the advertiser is trying to answer or that may conflict with the RWE.
