# Vacate RFK Jr. Covid Vaccine Recommendations: Lawsuit

A group of medical societies has filed suit against HHS secretary **Robert F. Kennedy Jr.** and FDA commissioner **Marty Makary** to reverse a 5/27 decision ([see earlier story](https://www.fdaweb.com/covid-vaccine-nixed-for-children-pregnant-women/)) to revoke Covid-19 vaccine recommendations for children and pregnant people. The [lawsuit](https://downloads.aap.org/AAP/PDF/FiledSuit.pdf?ref=fdaweb.com) was filed in the U.S. District Court for Massachusetts by the American Academy of Pediatrics, American College of Physicians, American Public Health Association, Infectious Diseases Society of America, Massachusetts Public Health Alliance, and Society for Maternal-Fetal Medicine.

Their complaint seeks preliminary and permanent injunctions to enjoin Kennedy’s rescissions of Covid vaccine recommendations and a declaratory judgment pronouncing the change in recommendations unlawful. “This administration is an existential threat to vaccination in America, and those in charge are only just getting started,” **Richard H. Hughes IV**, partner at Epstein Becker Green and lead counsel for plaintiffs, is quoted in a release as saying. “If left unchecked, secretary Kennedy will accomplish his goal of ridding the United States of vaccines, which would unleash a wave of preventable harm on our nation’s children.”

The suit contends that Kennedy’s order to remove the recommendations “stands in stark contrast to his sworn testimony only two weeks prior before Congress that ‘I don’t think people should be taking medical advice from me,’ and ‘what I would say is my opinions about vaccines are irrelevant.’” It notes that he promised multiple times during his Senate confirmation hearing to do nothing as HHS secretary that makes it difficult or discourages people from taking vaccines. The order, unless vacated, “will result in preventable deaths, including the unborn and newborns under six months old,” the suit says.
